Bob came to Migration Agency Australia after attempting to navigate his way through the 457 process himself to employ Pierre, a very diligent French national who was in Australia on a working holiday visa.
Unfortunately, Bob had already received a series of position nomination refusals, which had cost him hundreds of dollars. Not only was Bob getting very frustrated with the process, but he was very busy running his own demanding business.
Pierre’s working holiday visa was close to expiring and so he applied for a 457 visa to work in Bob’s business. Unfortunately, unknown to Bob and Pierre, the 457 application was never going to be approved as Pierre did not meet the application criteria.
Bob came to us at Migration Agency Australia to assess his situation and work on a strategy in which he could eventually sponsor Pierre to work for him. The problem was that even if Bob was able to gain approval for the nominated position, Pierre was never going to receive a 457 approval as did not meet the skills requirement.
After exploring all possible options for Bob and Pierre, the only solution was for Pierre to withdraw his 457 application so as to avoid a visa refusal and leave Australia within 28 days of his withdrawal. If Pierre waited to receive a refusal on his 457 application, he could have faced an exclusion period from applying for another Australian visa.
Pierre withdrew his application and returned to France to complete a course which would enable him to meet the skills requirement for a future 457 application. Once Pierre completes his course, Bob intends to sponsor Pierre to work for him in Australia. Had Pierre not withdrawn his doomed 457 application, he may never have had the opportunity to return to Australia to work for Bob.
